What is a consumer proposal in Canada?

A consumer proposal is a legally binding, government-regulated way to settle eligible unsecured debts for less than you owe in Canada. It’s filed and administered by a Licensed Insolvency Trustee (LIT) and is repaid through a fixed payment plan (up to 5 years)

How does a consumer proposal work?

A consumer proposal works by having a Licensed Insolvency Trustee review your finances, file an offer to your creditors, and set a fixed repayment plan you can afford. If the majority of creditors accept the proposal, it becomes legally binding on all unsecured creditors included, even those who voted against it.

Who qualifies for a consumer proposal in Canada?

You may qualify for a consumer proposal if you’re insolvent and owe between $1,000 and $250,000 in unsecured debt (debt that doesn’t have an asset tied to it, such as your car or house). A Licensed Insolvency Trustee confirms your eligibility and helps set a realistic payment amount based on what you can actually afford.

What debts can be included in a consumer proposal?

A consumer proposal can include unsecured debts like credit cards, payday loans, unsecured loans/lines of credit, and some tax debts. Secured debts (like a mortgage or car loan) aren’t usually included unless there’s an unsecured shortfall.

Does a consumer proposal stop interest?

Yes, a consumer proposal stops interest on the unsecured debts included once it’s filed. Your payments go toward the agreed settlement amount instead of ongoing interest and penalties on those included debts.
